The brand, logo, and slogan CASSIO Montana - Sports with attitude are registered trademarks of CASSIO Montana and the right of ownership is subject to the laws in force. The cassiomontana.org website is the property of CASSIO Montana. By offering donations and requesting the sending of club promotion products or tours on mountain trails, the user consents to receive notifications from cassiomontana.org. The club reserves the right to make changes to the terms and conditions on the website, without prior notice, for which it is necessary to read them carefully.

Site Content and Copyright

We undertake to constantly improve the information on the website. CASSIO Montana is the sole owner of the intellectual property rights on the site, respectively the design and content of the site, except texts and images provided by producers/suppliers, the club being protected by the law for the protection of copyright (Law no. 8/1996 ). The use without the consent of the club of any of the elements listed above is punished according to the laws in force (administrative, civil, or criminal). Thus, it is forbidden to access the cassiomontana.org site by devices or automatic programs or to manually copy and publish the content by other companies or sites.

Limitation of liability

We disclaim responsibility for any situation that may arise due to software errors or technical failures on the server. Regarding the images, they are displayed on the website as an example, and the delivered products / reserved tours may differ from the images in certain cases. If it happens that the price of the product or some of its characteristics have been incorrectly entered in our databases or displayed incorrectly due to the store schedule, and the delivery/reservation has not been made/consumed yet, we reserve the right to cancel the delivery of the respective product or to cancel the respective reservation and to notify the client as soon as possible about the error that occurred.

Limitation of obligations

In all circumstances, the client will agree that CASSIO Montana's liability to him for any damage caused by non-delivery or improper delivery/cancellation of the reservation will be limited to the amount collected by the club as a donation from the respective sponsor for the order/reservation in connection with which the problem in question appears.

Prices

We strive to offer the most affordable prices on the market for the products we offer. All product prices on the website are expressed in RON and do not include any additional taxes (eg VAT). However, the prices do not include the transport charges, which are calculated separately and will be sent to you upon completion of the order. We usually do not charge shipping fees. However, there may also be special situations for which the transport price will be explicitly shown to you at the end of the order/booking.

Tour bookings

Reservations for via ferrata tours, climbing, or other specific mountain activities are considered confirmed only after receiving the confirmation email or phone call. We assume the presence of the personnel necessary for training, equipping, and guiding at the place of activity 15 minutes before the set time. Exceptional cases that may cause delays will be communicated to the sponsor/donor promptly.

In case of bad weather, the activity is rescheduled by mutual agreement. The activities can only be rescheduled. Refunding is not available.

Orders

The products displayed on the cassiomontana.org website can be ordered exclusively using the shopping bag. In the case of an order, please enter your or your company's data correctly. The club undertakes to, after sending an order by a user, confirm by email the details about the products and delivery.

Delivery terms

The delivery term for products bought on cassiomontana.org and in stock at that time normally falls between 1 day and 5 days, a term that runs from the moment the order is confirmed on the cassiomontana.org website. In exceptional conditions, the club assumes the right to increase the delivery time, with the prompt notification of the customer.

Complaints and the right of withdrawal

All complaints regarding missing parcels or wrong billing must be made within 3 calendar days of receiving the parcel, to the address info@cassiomontana.org. We do not assume responsibility for complaints received after this period. If products are found to be missing from the package, we will send the missing products at our expense. You have the right to notify us in writing that you wish to cancel the purchase, without penalty and without giving a reason, within 14 working days of receiving the product. The above rule will only apply if the product is delivered in good condition, in the original packaging, undamaged, without any marks or other signs of improper use and the product has not been used. The only costs that can be borne by you are the direct costs of returning the products. In case of exercising the right of unilateral termination of the contract by you, our company will reimburse you the amounts paid, without asking you for additional fees. Reimbursement of the amounts will be made within 30 days at the latest from the date of termination of the contract.

Disputes

Any dispute arising between customers and the company will be resolved amicably. If it is not possible to resolve the conflict amicably, the jurisdiction rests with the courts.

Major force

Force majeure exempts from liability the party that invokes it under the conditions provided by the Romanian legislation in force.

Security of personal data and information

The owners of the cassiomontana.org site undertake to use the personal data entered by customers only for the purpose of delivering gift products for donations made, for accounting purposes as well as for the purpose of informing about the operation of the site and the offers/news presented by it.
